چالش های حقوقی و قضایی بیماران روانی - fatemehghazanfariyan - 22-03-2019 به نقل از پورتال مشاوره و مددکاری اجتماعی صبا پیام دکتر مهدی نصراصفهانی؛ دبیر کنگره “نخستین کنگره ملی چالش های حقوقی و قضایی بیماران روانی” در تاریخ گذشته ایران جایگاه بیماران روانی نسبت به سایر کشورهای جهان از موقعیت ممتازتری برخوردار بوده است. در حالی که در اروپای قرون وسطی بیماران را مأمن شیاطین می ‎دانستند، در ایران بخشی از دارالشفاء یزد به بیماران روانی اختصاص یافته بود. با ظهور ستارگان درخشانی در آسمان پزشکی ایران همچون زکریای رازی، ابوعلی سینا و جرجانی طب قدیم ایران به اوج ترقی رسیده و چندین سده، پرچم‎دار جهان پزشکی شد. مطالعه آثار این بزرگان به خوبی نشان می‎دهد که رویکردی که در اروپای قرون وسطی در مورد بیماران روانی وجود داشته، جایگاهی در تاریخ گذشته پزشکی کشور ما نداشته است. اما در دهه های اخیر باید اذعان نمود رویکرد بسیاری از کشورهای اروپایی به کلی عوض شده و رویکردی انسانی برای رعایت حقوق بیماران به کار گرفته شده است. بررسی قوانین موجود در ایران نشان می‎دهد که اگرچه قانون مستقلی برای بهداشت روان تا کنون تدوین نشده است اما از دیرباز در مجموعه قوانین مختلف کشور، اعم از قانون مدنی، قانون مجازات اسلامی، قانون امور حسبی، قانون دادن حضانت فرزندان صغیر یا محجور به مادران (مصوب مرداد ماه ۱۳۶۴)، قانون اقدامات تأمینی (مصوب اردیبهشت ۱۳۳۹)، قانون حمایت خانواده (مصوب بهمن ماه ۱۳۳۵) و قانون اجازه پرداخت حق الزحمه به بیماران روانی که در کارگاههای حرفه‎ای و یا رشته‎های خدماتی به کار گمارده می‎شوند به جنبه‎های مختلف حقوق بیماران روانی پرداخته شده است. در این قوانین از اصطلاحاتی همچون جنون، سفیه، اختلال مشاعر و … استفاده شده است که از نظر علمی بر سر تعریف روشن و مشخص آنها توافق وجود ندارد ولی به هر حال توانسته است تا حدودی مشکلات و معضلات بیماران را پاسخگو باشد. در مجموعه قوانین موجود همچنان ابهاماتی وجود دارد که حقوق بیماران نادیده انگاشته شده است. از جمله...... ادامه......
