در این مقاله به بررسی شریک جرم و حکم شراکت در جرم می پردازیم . 


فرض کنید که چند نفر با هم اقدام به ارتکاب جرمی مثل سرقت می کنند و بعد از تعقیب و دستگیری به دادگاه رفته تا در مورد جرم آنها رسیدگی شود . در این شرایط این که هر کدام از آنها تا چه میزان در جرم فعالیت داشته اند و هر یک با چه انگیزه و تحت چه عنوانی جرم را رهبری و هدایت کرده اند در عنوان مجرمانه آنها و میزان مجازاتی که برایشان در نظر گرفته می شود تاثیر گذار است . برای مثال شراکت در جرم با معاونت در جرم و مباشرت در جرم متفاوت است . ما در این مقاله به بررسی یکی از این سه عنوان یعنی شریک جرم و حکم شراکت در جرم می پردازیم . 


شریک جرم کیست
پاسخ به این سوال که شریک جرم کیست را می توان در ماده 125 قانون مجازات اسلامی سال 92 دریافت . طبق این ماده " هر کس با شخص یا اشخاص دیگر در عملیات اجرایی جرمی مشارکت کند و جرم مستند به رفتار همه آنها باشد خواه رفتار هر یک به تنهایی برای وقوع جرم کافی باشد خواه نباشد و خواه اثر کار آنان مساوی باشد خواه متفاوت شریک در جرم محسوب می شود " . بنابراین می توان گفت  کسی که در اجرای یک جرم دخالت کند ، بدون در نظر گرفتن این که جرم به واسطه رفتار یکی یا همه آنها به وجود آمده باشد و اینکه تا چه میزان در اجرای جرم اثر گذاشته اند ، شریک جرم محسوب می شوند .

مجازات شراکت جرم
در ادامه ماده 125 قانون مجازات اسلامی آمده است که " مجازات شریک جرم ، مجازات فاعل مستقل آن جرم است . در مورد جرائم غیرعمدی نیز چنانچه جرم ، مستند به تقصیر دو یا چند نفر باشد مقصران ، شریک در جرم محسوب می شوند و مجازات هر یک از آنان ، مجازات فاعل مستقل آن جرم است " . با توجه به این ماده می توان گفت که حکم شراکت در جرم همان مجازات اصلی جرم است به طوری که گویی شریک جرم ، آن جرم را به طور کامل خودش انجام داده است .
